Linda Austin's Cakes - Terms of Service

A no-obligation consutation of one hour or less can be scheduled within our normal business hours to design your cake and sample flavors. Additional time for consultation appointments is available at a rate of $25/hr.

The number of cakes we create each week is limited, so if you would like to purchase a cake a non-refundable deposit is required to hold the date for you in our schedule. For wedding cakes of less than 100 servings the deposit is $100, for wedding cakes of more than 100 servings the deposit required is $200. For all non-wedding custom orders a deposit of 50% is required when ordering. These deposits are non refundable in the event of cancellation.

Changes to an existing order [size, style, flavor, filling, or decorations] will be accepted until 7 days prior to the event. After that there will be a "change" charge of $75 for ANY modification to the order.

A rental fee of $50 is required if your cake uses items that will need to be returned to us (pillars, cake plates, fountains, etc.). If the items are returned to us within 1 week of the event the rental fee will be waived. If we are required to pick up the items the rental fee will NOT be waived. A late fee of 25% of the replacement value of the items will be imposed per month if not returned within 30 days. All items remain property of Linda Austin's Cakes.

Deliveries are taken on a first-come, first served basis and must be arranged with a practical concern for the delivered product. Our delivery personnel are renowned for their promptness and ability to care for each cake. Therefore, we reserve the right to make delivery decisions based on our experience of what is best for the cake. The delivery fee charged is based on the travel time to the location, set-up time required for your style of cake, and the number of persons required for the delivery. We guarantee the cake's safe delivery and set-up, however, our responsibility for the cake ends after the delivery (or store pick-up). If no one is on site at the arranged time of the delivery or if we cannot gain entry to the building, then we will return the cake to the bakery. The responsibility for the delivery then becomes yours. Please take time to review delivery arrangements with the reeption site to ensure this does not happen.

Completion of the cake design and full payment (including rental fee) is required by one month prior to the wedding date. If the cake is ordered less than one month in advance, the date will NOT be confirmed until full payment is received.

We reserve the right to make slight changes to the style of decoration of your cake if artistically necessary. We want your cake to look its absolute best!

Our cakes and sweets are made from the best ingredients - but are subject to the laws of nature! All frostings (except rolled fondant), and chocolate items are suceptible to heat annd can melt in a hot car, reception hall, or outdoors in warm weather. We are happy to recommend heat-resistant items if you are planning a warm weather event.

We reserve the right to photograph all products we make and use those images in promotional materials.

All our products are made using equipment that may have been used to process nuts and food coloring dyes. Please inquire regarding special dietary needs BEFORE ordering.

Changes to these terms must be in writing, signed by the buyer and authorized representative of Linda Austin's Cakes and Gourmet Sweets.
